CLE-Against All Odds: How a Rehabilitation Straight and Narrow Beats a Prison Full House Under Nevada's Problem Gambling Diversion Laws
The William S. Boyd School of Law, in cooperation with the Nevada Council on Problem Gambling, will host a CEU/CLE on the Gambling Diversion Program on October 22, 2015.
The CEU/CLE will provide an overview of NRS 458A, the Nevada Problem Gambling Diversion Program, and examples of the types of legal cases in which use of the program could be beneficial for clients. Attendees will hear from experts on problem gambling and be provided resources outlining the process of preparing for court when utilizing the diversion program.
2:00-3:00pm: Introduction to problem gambling - Denise Quirk, M.A. CEO and Clinical Director of the Reno Problem Gambling Center and Chair of the Governor’s Advisory Committee for Problem Gambling
Attendees will learn about problem gambling and what to look for when talking to a client that would suggest that problem gambling could be the issue underlying their crime. Attendees will also gain knowledge about problem gambling assessment, including what questions are asked on problem gambling assessment instruments, which professionals can perform an assessment, and which clinics are funded by the state of Nevada that can provide assessment and problem gambling treatment services for free.
3:00-4:00pm: NRS 458A, the Nevada Problem Gambling Diversion Law - Anthony Cabot, Partner, Lewis, Roca, Rothgerber
Attendees will learn when the problem gambling diversion law may be utilized within a court case; specifically, which clients are eligible to use the diversion program and the findings the court must make to determine if the program can be utilized. Attendees will be trained on the requirements of assignment to the program for the defendant, and the courses of action that result from successful and unsuccessful completion of the program.
4:00-5:00pm: Preparing a legal case utilizing NRS 458A - Dayvid J. Figler, Esq. Figler Law Group
Attendees will learn about the challenges of preparing a case utilizing the gambling diversion program. Some topics covered include: use of the problem gambling diversion program in adjudicated cases where the program was appropriate but not utilized in initial sentencing; gathering the required documentation to support utilization of the program; the expectation of large amounts of restitution as a barrier to entrance into the program; and establishing the importance of setting a precedent of utilizing the diversion program.
Learning Objectives:
1. Attendees will recognize indicators that a client may struggle with problem gambling.
2. Attendees will understand the process clients must go through to seek and receive problem gambling treatment.
3. Attendees will learn where to refer clients for problem gambling treatment that is funded by the state of Nevada.
4. Attendees will identify the types of cases when the problem gambling diversion law is appropriate to utilize.
5. Attendees will understand the requirements of the problem gambling diversion program.
6. Attendees will identify the necessary documentation required to support utilization of the problem gambling diversion program.
7. Attendees will learn strategies for encouraging application of the problem gambling diversion program in sentencing.
