This Symposium is centered around the Nevada Law Journal’s most recent White Paper, entitled The Elephant in Nevada’s Hotel Rooms: Social Consumption of Recreational Marijuana, a Survey of Laws, Issues, and Solutions. While recreational marijuana is now legal in several states, Nevada’s legalization of marijuana presents a unique challenge—recreational marijuana is legal to purchase, but public consumption is a misdemeanor punishable by fine. This situation presents a problem for Las Vegas’s forty-million annual visitors who may legally purchase marijuana but have no place to legally consume it. The White Paper analyzes the Regulation and Taxation of Marijuana Act and surveys the approaches of other legalizing states, and ultimately proposes legislation to address Nevada’s public consumption problem.
The Elephant in Nevada’s Hotel Rooms will begin with opening remarks from Congresswoman Dina Titus and Nevada Supreme Court Chief Justice Michael L. Douglas. Attorney General, Karl Racine, will discuss the current state of federalism and marijuana, followed by one of the White Paper authors, Brent Resh, discussing the findings of the White Paper. The first panel of the day will discuss what legalizing states are doing to tackle the problem of public consumption, followed by a panel of General Counsel from local hotel and casino properties discussing the implications of legalized marijuana for resort properties. The third panel will feature legislators and regulators discussing how legislation may be able to fix the current problem with public consumption, and finally, the last panel will discuss the impact of legalized marijuana on Nevada tourism and tax.
