Conducting Ethical Negotiations

This program will explore the tension between lawyers’ obligations to clients and their responsibilities to others when negotiating.  Professor Art Hinshaw will walk through lawyers’ ethical requirements when negotiating and then present the findings of a recent study in which he examined the extent to which attorneys were willing to engage in a fraudulent settlement strategy when asked to do so by a client. Following Professor Hinshaw’s presentation, a panel of practitioners will provide commentary based on their experiences in a number of practice areas.
