Please join us as Dean Daniel Hamilton welcomes symposium attendees and introduces the authors of the Nevada Law Journal’s feature white paper, “To Bail or Not to Bail: Protecting the Presumption of Innocence in Nevada.” The authors, Ebeth Palafox and Brendan McLeod, will provide a brief overview of the tripart solution presented in their work.
Pretrial Release Reform in Context

Nevada Supreme Court Justice James Hardesty will introduce Nevada Attorney General Aaron Ford and Maryland Attorney General Frosh, who will explain their work on criminal justice reform and discuss how pretrial release reform affects and improves the criminal justice system overall.

The Possibility of Changing Directions from the Bench

In December 2018, the Honorable James Hardesty filed a petition to adopt a statewide requirement that all judges use a validated risk assessment tool in pretrial decision-making. Justice Hardesty’s petition reflects the view that pretrial release reform can and should be immediately implemented by the Nevada judiciary. This panel will focus on the potential risks and benefits of a judiciary-centered approach.

The Impact of Reform on Criminal Justice in Nevada

Panelists will discuss how movement away from Nevada’s current cash bail system will affect the practice of criminal law and the functionality of the Nevada courts.

Where Do We Go from Here?
Discussing Nevada’s New Legislative Committee

Under Senate Concurrent Resolution No. 11 (SCR11), the Nevada Legislature directed the Legislative Commission to appoint a committee to conduct an interim study of issues relating to pretrial release. SCR11 outlines eight areas of study for the new committee and provides a catchall for other matters relevant to the pretrial release of criminal defendants. This panel focuses on potential topics of study and ways the committee can inform future legislation.
