Overview

 

UNLV Boyd Law School's Saltman Center for Conflict Resolution and the Black Law Students Association present a panel discussion on the early neutral evaluation of employment discrimination cases in Nevada's federal courts. Local Rule 16-6 requires all employment discrimination cases filed in the United States District of Nevada to "undergo early neutral evaluation" (called "mediation" by some) by a magistrate judge. The purpose of ENE according to the rules is "to give the parties a candid evaluation of the merits of their claims and defenses."

 

This panel will discuss how the mandatory early neutral evaluation of discrimination cases in federal court work, how the process compares to uses of mediation in the private sector, dispute resolution strategies used by plaintiff-side and defense-side attorneys in this process, as well as insights about the process from a magistrate judge tasked with evaluating these cases.
