Program description
This presentation provides an overview of landmark Supreme Court cases that have shaped the legal status of the United States Territories and their inhabitants since 1900. A summary of the historic Insular Cases will provide a context for understanding the hotly-contested constitutional issues now before the courts. Specifically, the presenters will cover two current cases that concern the rights of residents of the territories of Puerto Rico and American Samoa. This course addresses questions of constitutional law and U.S. nationality law and offers insight on how the Supreme Court may decide on them. There will also be a brief discussion of proposed legislation in Congress that aims to change the territorial status of Puerto Rico in the near future.
