In exercising their regulatory authority, medical licensing boards compromise patient welfare in two troubling ways. On one hand, licensing’s many rules and restrictions lead to provider scarcity, which in turn leaves many of us without access to life-saving medical and legal services. On the other hand, lax disciplinary systems put offending physicians back to work, leaving patients and clients vulnerable to unethical, incompetent, and predatory professionals.
