The Nevada Supreme Court recently amended SCR 252 to provide a procedure for settlement conferences to facilitate good faith discussions to resolve any criminal case before the district court in a manner that serves the interest of justice.  As a result, and for the first time in Nevada jurisprudence, either party in any criminal case before the district court may request a settlement conference or the trial judge may on its own, recommend that counsel with settlement authority participate in a settlement conference.

The presenters will discuss the process of forming a viable settlement conference protocol as well as the challenges and goals of criminal settlement conferences; how to make the most out of a criminal settlement conference, as well as shaping a dialogue as a more formalized procedure takes shape; how alternative dispute resolution is used in criminal cases; and the prosecutor’s role in criminal settlement conferences.
