Professor Bayer asserts that the Framers and the Reconstruction Congress agreed that government is legitimate only if it en¬forces the natural law principles set forth in the Declaration of Independence and understood that those principles are moral precepts im¬posing moral duties on Government and its officers at all levels including the judi-ciary. He argues that duty requires Gov¬ernment actions and Judicial decisions to reflect the best moral philosophy availa¬ble at the time decisions must be made.
